Dispute Resolution Policy
At OM & Beyond Wellness, we are committed to providing high-quality services, including massage therapy, reiki energy healing, and spiritual life coaching, and ensuring a positive experience for all our clients. However, it is important to understand that client satisfaction is subjective and can be influenced by many personal factors. We strongly encourage open communication to address concerns and will make reasonable efforts to resolve disputes in a fair and amicable manner. This Dispute Resolution Policy outlines the process and the expectations of both parties in case of a disagreement:
1. Client Responsibility and Acknowledgement
By booking and participating in services provided by OM & Beyond Wellness, you acknowledge that the effectiveness of the services depends on your openness, active participation, and personal circumstances. Results vary among individuals, and the progress you make is largely influenced by your level of engagement and commitment to the process. OM & Beyond Wellness does not guarantee specific results or outcomes, including but not limited to physical, emotional, or spiritual improvements. As a client, you are solely responsible for your own progress.
2. Informal Resolution Process
In the event you feel unsatisfied with any service provided, we encourage you to contact OM & Beyond Wellness directly at [email address] or through our customer service channels within 7 days of your session. We will listen to your concerns and strive to understand your needs. While we will do our best to address your concerns, please note that dissatisfaction with the outcome of the services does not automatically warrant a refund, alteration of service, or compensation.
3. Mediation
If the informal resolution process does not resolve the issue, both parties agree to attempt mediation with a neutral third-party mediator. Mediation will be conducted in good faith to explore possible solutions. The cost of mediation will be split equally between both parties unless otherwise agreed upon. Mediation must be completed within 30 days of the formal request.
4. Arbitration
If mediation does not yield a satisfactory resolution, both parties agree to submit the dispute to binding arbitration, which shall be final and binding. Arbitration will take place in the province of Alberta, Canada, and will be conducted in accordance with applicable laws. The decision of the arbitrator will be enforceable in any court of competent jurisdiction. Each party will bear its own costs associated with arbitration unless the arbitrator determines otherwise.
5. Accountability and Client Progress
It is important to recognize that the services provided by OM & Beyond Wellness are not a guarantee of specific results. Clients are responsible for their own progress, both during and after participating in services. While our practitioners strive to create a safe, supportive, and effective environment, the outcomes of any session depend on various factors, including the client's commitment and participation. Any dissatisfaction with the process or the perceived lack of progress does not constitute grounds for a refund or a claim against OM & Beyond Wellness.
6. Limitations of Liability
OM & Beyond Wellness is not responsible for any results or lack thereof arising from participation in services such as massage therapy, reiki energy healing, or spiritual life coaching. You agree to release OM & Beyond Wellness, its practitioners, and affiliates from any claims, damages, or losses associated with your progress or the perceived outcomes of services. We do not guarantee that any particular goals will be achieved through our services.
7. Legal Action
If both mediation and arbitration fail to resolve the dispute, either party may seek resolution through legal action in the courts of Calgary, Alberta, Canada. The governing law for any disputes arising under this policy will be the laws of the province of Alberta.
8. Timeframe for Resolution
We aim to resolve disputes in a timely manner. Clients must submit any formal complaints or requests for dispute resolution within 30 days of the service in question. Dispute resolution, including informal resolution, mediation, and arbitration, should ideally be completed within 60 days from the date of the initial complaint.
9. Costs
Clients and OM & Beyond Wellness will each bear their own costs associated with the dispute resolution process unless otherwise determined by a mediator or arbitrator. This includes, but is not limited to, legal, mediation, and arbitration fees.
