(a) Client Responsibility: By booking any of our services, you acknowledge and agree that the effectiveness of the session depends on your openness, participation, and personal circumstances. OM & Beyond Wellness does not guarantee specific outcomes, and your engagement is crucial for the success of the service.

(b) Individual Experience: Each client may have a unique experience with the services offered. Results may vary, and OM & Beyond Wellness does not make any claims regarding the success or outcome of any service for any individual.

(c) No Refunds: There is no refund on any services, products, or sessions provided, including massage therapy, Reiki energy healing, or spiritual life coaching.

3.2 Limitation of Liability

(a) Assumption of Risk: You understand and acknowledge that the success of services such as massage therapy, Reiki energy healing, or spiritual life coaching depends on various factors, including your openness and individual circumstances. OM & Beyond Wellness is not liable for any perceived lack of success or desired outcomes from participating in these services.

(b) No Guarantees: OM & Beyond Wellness makes no guarantees or warranties, expressed or implied, regarding the results of any services provided. Your engagement and effort contribute significantly to the potential benefits of the services.

(c) Release of Liability: By participating in any services, you release OM & Beyond Wellness, its practitioners, and affiliates from any liability, claims, or damages arising out of or in any way connected to your participation in these services.

3.3 Consultation and Professional Advice

(a) Not a Substitute for Professional Advice: Our services, including massage therapy, Reiki energy healing, and spiritual life coaching, are not substitutes for medical, psychological, or other professional advice, diagnosis, or treatment. It is strongly recommended that you consult with a qualified professional for specific health, psychological, or medical concerns.

(b) Disclaimer: OM & Beyond Wellness is not responsible for any decisions made or actions taken based on the information provided in the services. You are encouraged to consult with appropriate professionals for advice tailored to your unique situation.

4. Code of Conduct

(a) Respectful Behavior: Clients are expected to engage in respectful and supportive behavior during services and related communications.

(b) Non-Discrimination: Discrimination, harassment, or any form of disrespectful conduct towards other clients or OM & Beyond Wellness staff will not be tolerated.

(c) Compliance: Clients must comply with all service guidelines, instructions, and applicable laws.

5. Intellectual Property Rights

(a) Ownership: All intellectual property related to our services, including but not limited to session materials, remains the property of OM & Beyond Wellness.

(b) Use Restrictions: Clients are not authorized to reproduce, distribute, or use session materials for any purpose without explicit written consent from OM & Beyond Wellness.

6. Payment Terms, Cancellation and Modification

Full payment for Reiki and Spiritual Life Coaching Services are due prior to the time of the session. OM & Beyond Wellness accepts payment through [Credit Cards, Debit, Interac eTransfer]. For packages or multiple-session bookings, full payment may be required upfront.

(a) Cancellation Policy: Cancellations must be made at least 24 hours before your scheduled appointment. Failure to do so may result in a cancellation fee.

(b) Modification: OM & Beyond Wellness reserves the right to modify service details or schedules. Clients will be notified of any changes in a timely manner.

7. Compliance with Laws

Clients are responsible for complying with all applicable laws and regulations.

8. Data Protection and Privacy

(a) Collection and Use: Refer to our Privacy Policy for information on the collection and use of personal data.

(b) Security: We take measures to protect your personal information. However, no method of transmission over the internet is entirely secure.

9. Dispute Resolution

(a) Procedures: Disputes will be resolved through mediation or arbitration, as specified in our Dispute Resolution Policy.

10. Termination of Access

OM & Beyond Wellness reserves the right to terminate or restrict a client’s access to the services without notice for any reason.

11. Modification of Terms

These Terms and Conditions may be updated from time to time. You will be notified of changes, and continued use of the Website constitutes acceptance of the modified terms.

12. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the province of Alberta, Canada. Any disputes arising from or related to these terms shall be resolved exclusively in the courts of Calgary, Alberta.

13. Health & Safety Disclaimer

You agree to inform OM & Beyond Wellness of any medical conditions, injuries, or health concerns prior to receiving services. If you are pregnant, have a medical condition, or any serious health issues (e.g., heart conditions, injuries, or skin conditions), it is recommended to consult with a healthcare provider before engaging in our services. OM & Beyond Wellness practitioners reserve the right to refuse service if deemed necessary for your safety.

14. Emergency Situations and Medical Concerns

In the event of an emergency, OM & Beyond Wellness will immediately discontinue services and refer you to medical professionals if needed. It is the client's responsibility to seek medical advice or treatment for any health issues they may have. OM & Beyond Wellness is not liable for any medical complications that may arise during or after services.

15. Third-Party Services

OM & Beyond Wellness may recommend third-party products or services to complement our offerings. However, we are not responsible for the quality, delivery, or results of any third-party services or products. All purchases of third-party services/products are the responsibility of the client.

16. Force Majeure

OM & Beyond Wellness shall not be held liable for any failure or delay in performance of services due to circumstances beyond our control, including but not limited to acts of God, natural disasters, pandemics, strikes, or government regulations. In such cases, clients will be notified, and services will be rescheduled as soon as feasible.

17. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remainder of the provisions will continue in full force and effect.

18. Indemnification

You agree to indemnify and hold harmless OM & Beyond Wellness, its practitioners, and affiliates from any claims, damages, losses, or liabilities, including attorney’s fees, arising out of your participation in services provided.

19. Client Feedback and Testimonials

By participating in services, you grant OM & Beyond Wellness permission to use any feedback, reviews, or testimonials you provide for promotional purposes. Any personal data used in these testimonials will be handled in accordance with our Privacy Policy.

20. Disclaimer

By using our services, you acknowledge and agree that the services provided by OM & Beyond Wellness, including massage therapy, Reiki energy healing, and spiritual life coaching, are not intended to diagnose, treat, or cure any medical or psychological condition.
